<br /> <br />J' " :! ~il 0; <br /> <br />South Platte River Compact. Salient Provisions <br /> <br />Divides Colorado into the "upper" and "lower" sections. The lower section lies east of the <br />western boundary of the Washington County line and extends to the state line ~tween Colorado <br />and Nebraska. The lower section is impacted by the provisions of the South Platte River <br />Compact. The upper section lies west of the Washington County line and is not impacted by the <br />provisions of the compact. <br /> <br />- "Flow of the River" is the flow at the interstate station (Jules burg} plus inflows accruing <br />betv.'een the station and Western Canal. <br /> <br />- Between October 15 and April I of each year. Colorado has the uninterrupted use of the flow of <br />the river subject to Article VI. <br /> <br />. Between April I and October 15 of each year. Colorado must curtail diversion:; that are junior <br />to June 14, 1897 if the flow at the interstate station is less than 120 cfs. <br /> <br />- Article VI allows Nebraska the right to construct the Perkins Co. Canal to divert up to 500 cfs <br />under a Dec. 17, 192 I-date. subject to following constraints: <br /> <br />a. Colorado appropriations, existing and future, are not affected in the upper section. <br />b. Colorado appropriations in the lower section senior to 12-17-21 are not affected. <br />c. Colorado is allowed 35,000 AF of storage ahead of the Perkins Co. Canal regardless of <br />the tinting of perfecting this amount <br /> <br />. Article III essentially allows Nebraska full use of the waters of Lodgepole Creek in Nebraska. <br />Colorado has use of Lodgepole Creek in Colorado. but flows in Colorado are relatively small. <br /> <br />- Article V allows the Peterson Canal in Colorado to carry wo.:er for irrigation (}f lands in <br />Nebraska. <br /> <br />- <br /> <br />
