<br />issued shall furnish to the state en- <br />gineer, prior to such expiration, evi- <br />dence that the water from such well has <br />been put to beneficial use, or unless <br />prior to such expiration the state <br />engineer, upon application, with good <br />cause shown, as to why the well has not <br />been completed and an estimate of the <br />time necessary to complete the well, <br />extends such permit for enxy-ene <br />AN additional period ee~~a~n7-net-te <br />exeeecl-ene-yec~ UPON A SHOWING OF <br />CONTINUING NEED to USE WATER FROM <br />SUCH WELL, but the limitation on the <br />extension of well permits provided for <br />in this paragraph (a) shall not apply to <br />well permits for federally authorized <br />water projects contained in paragraph <br />(d) of this subsection (3). The state <br />engineer shall charge a reasonable fee <br />for such extension. MORE THAN ONE SUCH <br />EXTENSION MAY BE PERMITTED BY THE STATE <br />ENGINEER. <br /> <br />3. Section 37-90-137(4) is amended as follows: <br /> <br />(4) In the issuance of a permit to <br />construct a well ~n-~he~e-cqtt~fe~~-wh~eh <br />cle-nee-ffleee-ehe-clefin~~iens-ef-~ee~ien <br />3~-ge-xa3f6t-e~-~ee~~en-3~-9~-xe3fx~t7 <br />cnd-cle-ne~-mee~-ehe-eXeffl~eion~-set-fe~th <br />in-~ee~ieng-3~-ge-xe5-and-3~-9~-6e~7 <br />OUTSIDE A DESIGNATED GROUND WATER BASIN, <br />NOT MEETING THE EXEMPTION SET FORTH IN <br />SECTION 37-92-602, IN AN AQUIFER, OR ANY <br />PORTION THEREOF, IN WHICH THE GROUND <br />WATER SUPPLY IS NON-RENEWABLE, the pro- <br />visions of subsections (1) and (2) of <br />this section shall apply; except that, <br />in considering whether the permit shall <br />be issued, only that quantity of water <br />underlying the land owned by the appli- <br />cant e~-hy-~fte-ewne~~-ef-ehe-crea-by <br />~he~~-eon~en~7-ee-be-se~vecl, OR UNDER <br />LAND OWNED BY ANOTHER WHO HAS CONSENTED <br />IN WRITING TO APPLICANT'S APPROPRIATION, <br />i~ SHALL BE considered eo-be unappro- <br />priated; the minimum useful life of the <br />aquifer i~ SHALL BE one hundred years, <br />assuming that there is no substantial <br />artificial recharge within said period; <br /> <br />-2- <br />
