Permlt dec1sions of the state engineer are flnal and have <br />the same effect as a water court decree, lf not appealed to <br />the water court. <br /> <br />12. Appeals of the state englneer' permitting declslons to <br />water court are de ~, unless formal evidentiary <br />proceedings were used, <br /> <br />13. Nontributary groundwater rules and regulations will be <br />reviewed under the APA standard (i.e., not trial de ~), <br /> <br />14. Groundwater Commlssion has broad authority over allocation <br />and use of nontr1butary groundwater, including authority to <br />establish the life of the aquifer, the permissible pumping <br />rate, the prlority of uses for such water, the protection <br />of existing uses and rights, and procedures for averaging <br />depletion and for recharge. <br /> <br />15.
