<br />Subcommlttees were asslgned the tasks of developlng the d'fferent <br />proposals. One drafted a "mln1mum changeU proposal; the other a <br />"revlsed Groundwater Management Act" wh1ch lncludes more extensive <br />changes. <br /> <br />Both subcommlttees agreed on us1ng a new, clearer def1n1t1on of <br />"nontr1butary" as follows: <br /> <br />Non-tr1butary groundwater 1s that groundwater wh1ch, 1f <br />w'thdrawn, would not affect the flow 1n a natural stream in an <br />annual amount greater than one percent of -the maximum annual <br />amount allowed to be withdrawn, w1th'n one hundred years of the <br />t'me w1thdrawal beg1ns. <br /> <br />A. "'nimum change proposal. <br /> <br />The minimum change proposal included in Append1x B, <br />reflects the conclusions of the Committee that at a minlmum, <br />leg1slat1on should be enacted to: <br /> <br />o Clarify the definition of nontributary groundwater. <br /> <br />o E11m1nate the MdiligenceU requ1rements that force a <br />permltted well to be developed and used w1th1n a per10d of <br />one year (plus a one year extension). <br /> <br />o Provide for allocation and admin1stration of partlally <br />tr1butary water. <br /> <br />o Determ1ne the scope and forum for judic1al rev1ew. <br /> <br />-25- <br />
