<br /> <br />" <br /> <br />ER 1105-2-100 <br />28 Dec 90 <br /> <br />SECTION VIII - FISH AND II'ILDLIFE IMPROVEMENT 1/ <br /> <br />4-34. Federal Interest. Congress, in the Fish and Wildlife Coordination Act of <br />1958, as antended, and the Federal Water Project Recreation Act of 1965, as <br />amended, declare it national policy that in inVestigating and planning any <br />Federal navigation, flood control, or mu~tipurpose water resource project, full <br />consideration shall be given to the opportunities, if any, which the project <br />affords for fish and wildlife conservation and improvement. The Corps may <br />recommend fish and/or wildlife conservation and improvement as a proj ect purpo!,e <br />in reports to Congress when certain conditions concerning resource significance, <br />constraints on allocated costs, and requirements for non-Federal participation <br />are met. <br /> <br />4-35. !yues of Improvements. The types of actions that fall within the intent <br />of fish and wildlife conservation and improvement are those structural and <br />nonstructural measures that contribute to increasing the quantity of identified <br />species and/or improving the quality of their habitat. ' Exantples are proteetive <br />fencing, land cover manipulation, water diversion channels, sub impoundment dams, <br />selective clear, cutting, planting of food. and cover vegetation, species <br />relocation, wetland restoration . and creation, low flow augmentation, land <br />acquisition, and the enforcement of protective regulations. It is necessary to <br />first establish fish and wildlife improvement planning objectives to be able to <br />measure and evaluate the contributions of proposed management measures. ,In this <br />regard, key definitions, planning and evaluation procedures, significance and <br />justification criteria, constraints, and report requirements are provided in <br />Chapter 7, Section VI, of this regulation. If a water resources plan or project <br />causes adverse impacts to fish and wildlife resources, 'improvements may not be <br />considered as enhancem..nt until all losses 'to these same resources have been <br />mitigated. <br /> <br />4-36. Specific Policies. <br /> <br />a. Public Involvement. District commanders shall initiate general public <br />participation procedures, for fish and wildlife resource improvement purposes, <br />consistent with guidance set forth in Chapter 5, Section III of this regulation. <br />Such public involvement shall include government' entities at the Federal, <br />regional, State, and local levels and national ,and local public and private <br />organizations, including Indfan :ribes. <br /> <br />b. Coordination. District commanders shall comply with the Fish and <br />Wildlife Coordination Act. by giving full consideration to reports and <br />recommendations furnished by theFYS and NMFS, and the appropriate head of th~ <br />State agency exercising administration ~ver ~efish and wildlife resources. <br /> <br />11 For the purpose of this Section fish and wildlife improvelllent shall include <br />non-~itigation restoration activities. <br /> <br />" <br />.---';'" <br /> <br />il <br />~, <br />;V <br /> <br />4-61 <br /> <br />~ <br />
