Subsequently, as discussed in <br /> <br />Section V below, by vote of the qualified voters of the District <br /> <br />held in 1927, the District elected to become subject to the Law of <br /> <br />1921. The records show that Palisade District was originally <br /> <br />organized under the Irrigation District Law of 1901 as discussed <br /> <br />in Section IV of this report. <br /> <br />A raview of the present state statutes pertinent to the role <br /> <br />proposed to be played by a district under the Salinity Control Act <br /> <br />leads to the conclusion that amendments to such statutes are <br /> <br />either necessary or desirable. We have drafted proposed <br /> <br />amendments (the "Proposed Amendments") which are enclosed with <br /> <br />this report as Attachment 1. The following paragraphs will set <br /> <br />forth the legal rationale or justification for each of the <br /> <br />suggested amendments. <br /> <br />1. Basic Approach to Amendments. The ap':)roach we have <br /> <br />taken with respect to the Proposed Amendments has been to limit <br /> <br />applicability thereof, as closely as possible, -to a Contracting <br /> <br />District while functioning under a Salinity Con-trol Contract. It <br /> <br />is thought that such an approach will facilitate enactment of the <br /> <br />Proposed Amendments by eliminating general effect upon all <br /> <br />irrigation districts. <br /> <br />2. Power to Contract Under Salinity Control Act.
