If <br /> <br />such amount were then subtracted from actual costs of operating <br /> <br />and maintaining the new system, the Contracting District would <br /> <br />have to obtain the additional required funds from district taxes <br /> <br />or toll charges. The boards of directors of Mesa County and <br /> <br />Palisade Districts are presently unwilling to proceed with a <br /> <br />Salinity Control Contract if such a result could occur. <br /> <br />In addition to the above, the Boards of the Districts are <br /> <br />concerned because the Salinity Control ~ct apparently provides <br /> <br />that any reimbursement due a Contracting District pursuant to <br /> <br />Section 1592(b)(2) of the Salinity Control Act shall be repaid <br /> <br />without interest in the fiscal year next succeeding the fiscal <br />year in which such operation and maintenance costs were incurred.l <br /> <br />I Section 1595(a) of the Salinity Control Act concerns <br />repayment of reimbursable portions of expenditures allocated to <br />the Upper Colorado River Basin Fund and the Lower Colorado River <br />Basin development fund. Regardless thereof, the fOllowing <br />independent sentence appears therein: <br /> <br />Any reimbursement due non-Federal entities pursuant to <br />Section 1592(b)(2) of this title shall be repaid without <br />interest in the fiscal year in which such operation and <br />maintenance costs are incurred. <br /> <br />Does this provision mean that reimbursements for operation and <br />maintenance costs may not be made by the Secretary to a <br />non-Federal entity until the year following the year in which such <br />costs were incurred? If so, a serious problem exists for any <br />Contracting District. This matter requires clarification by <br />amendment to the Act or by some other satisfactory means. <br /> <br />-4- <br />
