<br />['-- <br />'Y) <br />00 <br />.;::; <br />o <br />o <br /> <br />3. <br /> <br />An election be held pursuant to the Section 34-42-140, <br />C.R.S., at which two-thirds of the voters voting vote in <br />favor of the District's becoming subject to the Law of <br />1921. <br /> <br />4. An election be held at which the qualified voters <br />of the District authorize the District to enter <br />into a Salinity Control Contract. <br /> <br />The following actions should be taken in order for the Mesa <br /> <br />County Irrigation District to serve as a Contracting District: <br /> <br />1. The Proposed Amendments be enacted into law. <br /> <br />2. Remedial Amendment B be enacted into law <br /> <br />3. An election be held pursuant to Remedial Amendment B, as <br />therein provided, at ,,,hich the voters of the District <br />ratify its existence. <br /> <br />4. An election be held at which the qualified voters of the <br />District authorize the District to enter into a Salinity <br />Control Contract. <br /> <br />.ole also conclude that the bylaws of each of the Districts <br /> <br />should be rewritten and, as so rewritten, adopted by the <br /> <br />respective boards of directors. <br /> <br />When the steps enumerated above have been duly accomplished, <br /> <br />in our opinion Mesa County District and Palisade District will <br /> <br />each have the legal authority and power to acquire such real <br /> <br />property interests in the laterals under its system and to do such <br /> <br />other things as will enable it to contract for the construction <br /> <br />and long term operation and maintenance of the improved laterals <br /> <br />pursuant to the Salinity Control Act. <br /> <br />-18- <br />
