The first of such sentences grants a Contracting <br /> <br />(~) District the power of eminent domain and dominant eminent domain <br /> <br />to acquire existing lateral ditches, pipelines and interests <br /> <br />therein, easements, rights of way and such other rights and <br /> <br />interests in property as may be required in order to carry out the <br /> <br />purposes of a Salinity Control Contract. <br /> <br />4. Elimination of Necessity for Vote in Condemnation <br /> <br />Proceedings. <br /> <br />Section 37-41-113(5) of the Law of 1905 and Section <br /> <br />37-42-113(2) of the Law of 1921 require that a vote of the <br /> <br />qualified voters of the district must be obtained before <br /> <br />condemnation proceedings may continue which involve compensation <br /> <br />for the taking of property of more than $25,000 or $20,000 under <br /> <br />the respective Laws. <br /> <br />The second sentence of paragraph (3) of the Proposed <br /> <br />Amendments seek to solve the problem mentioned above by providing <br /> <br />that, if the compensation to be paid for the taking or acquisition <br /> <br />of interests in property by a Contracting District is to be paid <br /> <br />or reimbursed by the United States, payment thereof need not be <br /> <br />submitted to a vote by the qualified voters of such district. <br /> <br />5. Elimination of Necessity for Vote in 'Jrder to Incur <br /> <br />Obligations. <br /> <br />Sections 37-41-113(4) and 37-41-125 of the Law of <br /> <br />1905 and Section 37-42-113(1) of the Law of 1921, provide that <br /> <br />contracts of the district obligating payment of more than <br /> <br />specified amounts may not be entered into by a district without <br /> <br />obtaining an authorizing vote of the qualified voters of the <br /> <br />district. Sections 37-41-125 of the Law of 1905 and 37-42-124 of <br /> <br />-8- <br />
