Box 11568 <br />Salt Lake City, UT 84147 <br /> <br />Dear David; <br /> <br />I had written down the following questions to ask of you and Dr. <br />Marchant in Phoenix today and decided they were polished enough <br />to put in the form of a letter to you as a ma~ter of record. <br /> <br />1, I noticed in the Phase II and III Program for Implementation <br />there was no time frame provided for completion of the studie~ <br />and the making of a decision by the Departmen~ of Interior. I <br />reviewed my notes from the constituent meeting in Laa Vegas and <br />you had said it was a goal of the Department of In~erior to have <br />the process completed by September, 1990. I heard, however, ~hat <br />at the Executive Review Committee meeting in Albuquerque on <br />January 13 a completion date of Fall of 1992 was discussed. <br /> <br />a, What is the time frame? <br /> <br />b, Why was a time frame not included in the implementation <br />document? <br /> <br />c, Can that be corrected? <br /> <br />d, What accounts for the disparity between two more years and <br />four more years of study? <br /> <br />2. And also related to the time frame from my understanding <br />of Phase III, to invoke NEPA all that has to happen is for the <br />basin states to say, "the proposed changes by the Department of <br />Interior in operating criteria can not be accommodated within <br />the existing criteria." I think the probabilities are very high <br />that the Phase II studies will only serve to further support <br />environmentalist convictions that changes considered necessary <br />to protect the downstream resource will need to be of such a <br />magnitude that the most likely response of the basin states will <br />be to trigger NEPA compliance, <br /> <br />So if Phase III is completed "on schedule" in the fall of 1992 <br />and if NEPA is invoked in January of 1993 as I anticipate <br />(unless judicially invoked before then), isn't it possible we may <br />not have a decision until 1996 or 1997? (Oh such a disturbing <br />possibility.., it certainly appears to me that the Canyon may <br />have to suffer at least six or seven more years of environmental <br />impact before mitigation measures are implemented.) <br /> <br />4050 E.
