<br />SUPPLEMENTARY INFORMATION: The
<br />proposal would establish a national
<br />wildlife refuge on up to 23,000 acres of
<br />wetlands and bottomland hardwoods
<br />along the confluence of the Green and
<br />Ohio Rivers in Henderson County.
<br />Kentuck.y. The Service is proposing to
<br />establish the refuge through a
<br />combination of fee title purchases from
<br />willing sellers and lease!!, conservation
<br />easemel1ts, or cooperative agreement!l
<br />from willing landowners.
<br />
<br />The goals of the proposed refuge
<br />would be to provide (1) Habitat for
<br />migrating and wintering waterfowl. {2}
<br />habitat for non-game land birds, (3)
<br />habitats for a natural di versity of fish
<br />and wildlife, (4) nesting habitat for
<br />wood duck, and other locally nesting
<br />migratory waterfowl. (s 1 quality hunting
<br />and sportfishing opportunities, and (6)
<br />opportunihas for environmental
<br />education. interpretation. and wildlife-
<br />oriented recreation.

<br />SUPPLEMENTARY INFORMATION: In its June
<br />3, 1963 opinion in the case of Arizona
<br />v. Cahfornia (373 U.S. 546). the
<br />Supreme Court of the United States held
<br />that \hit Congress has directed ilie
<br />Secretary oftbe Interior (Secretaryl to
<br />administer a network of useful projects
<br />constructed by the Federal Government
<br />on the lower Colorado River. and it has
<br />entrusted the Secretary with sufficient
<br />power to direct. manage, and coordinate
<br />their operation. The Court held that this
<br />power must be construed to permit the
<br />Secretary to allocate and distribute the
<br />waters of the mainstream of the
<br />Colorado River within the boundariBS
<br />set down by the Boulder Canyon Project
<br />Act [45 S,.1. 1057,43 U.s.c. 617)
<br />(BCP^l. The Secretary has enlared into
<br />contracts for the delivery of Colorado
<br />River water with entities in Arizona.
