<br />If by reason of storage eapacity in the Aspen Reservoir, the Twirl Lakes Reser-
<br />,'oir & Canal Co. derive:-; aridit.iOllll.1 water or other benefits or advantages it ~'ould
<br />not ha"e realized had this project. not been constructed, then nothing herein con-
<br />tained shall prevent the project from making appropriate charges tor such water
<br />or ot.her benefits Or advantaRes.
<br />11. All Jands acquired for project const.ruction and opera.tion and water sur-
<br />fAces of project reservoir" will be open to the public for recreat.iona.1 purposes,
<br />excepting those areas reserved by t.he operating agency.
<br />12. The project will be operated in such a manncrthut those in eastern Colorado
<br />using project water imported fnl[]l the Colorado River Basin for domestic pur-
<br />poses shall have preference over those claiming or using water for any other pUr~
<br />pose.
<br />13. The project i3 to be operated in such a manner 83 to secure the greatest
<br />benefit from the use and reuse of imported project waters within project bounda.ries
<br />in the State of Colorado.
<br />14. Any tlnd all benefits and rights of western Colorado water users in and to
<br />-"",-ater stored in Green Moulltain Reservoir, M desc.rihed and defined in Senate
<br />Document 80, Seventy-fifth Congress, first session, shall not be impaired or
<br />diminished by this project. .
<br />,.. 15. The project, its operation. maintenance, and use shaH be subject to the
<br />provisions of the upper Colorado River B&'lin compact of October 11, 1948
<br />.(Public Law 37, 81st Cong., 1 sess.), the Colorado River comp~ct of No'\'f~mber 24,
<br />1922 (H. Doe, 605, 67th Cong., 4th !'less.), and the Boulder Canyon Project Act
<br />of December 21, 1928 (45 Stat. 1057-1064). In the e'-ent any curtailment of use
<br />9f Colorado River water in the Stat.e of Colorado i!'l necessary to s8th:fy t.he pro~
<br />visions of the Colorado River compact or t.he upper Colorado River Basin eom~
<br />pact, the.n the diveT'8ion~ by the project for use in ea~te"fn C.olorado shall be
<br />curt~iled before there is any curtailment of the right to store water in Aspen
<br />,Reservoir in a quantity not in excess of the capacity of that reservoir for Use in
<br />western Colorado in accordance with. thesc opeM\ting principles.
<br />16. The Secretn.ry of t.he Interior shall at any Lillie ha.ve the option to obtain or
<br />require the transfer to the United States of any and an rights initia.ted or acquired
<br />bv the appropriat.ion or use of wBter through the works of the project in e88tern
<br />Color,ado, except vested rights to present appropriations; provided, however, tha.'t
<br />~he tItle so taken shall be s.ubject to a. beneficial use of such water &8 may be
