As llsed herein- <br />(a) "Project" means that certnin enterprise planned and designed by the <br />Bureau of Reclamation, Department of the Interior, for the transmountain <br />divcrsion of water from the headwaters of the Fryingpan River and other tribu- <br />taries of the Roaring Fork River to the basin of the Arkansas Ri....er, together <br />with an of its appurtenant work!:; and facilities in both eastern and western <br />Colorado. <br />(b) "Eastern Colorado" meaDS that portion of the State of Colorado lying <br />within t.he natural drainage basin of the Arkansas River. <br />(r) "Western. Colorado" mean:,;. that portion of the State of Colorado lying <br />wit.hin the natural draillage. basin of the Colora.do Rh'er and served by diversions <br />made from the Colorado River, or its tributaries, above its confluence with the <br />Gunnison River. <br />(rl) "ERstern Colorado Consen'ancy District" meRIlS that entit.y to be hereafter <br />created to cont.ract for pa.yment to the United States of al1l.\\)proprio.te: portlOU \){ <br />project costs allocah~d t.o certain water uses in eastern Colorado. <br />(e) "Aspen neser....oir" means 1Iot only the reservoir presently planned (or <br />cOlliltructioll near the town of Aspen 8S part of the J-lroject but. also, unless the <br />CQut.ext requires otherwi:.;,e, ally other rcservoir that mu)' be COll.<:;trllct,<<:d in westcrn <br />Colorado abo....e the to.....n of Aspen 'il\ lieu of that reservoir fOr the l>urp05e of <br />protecting wat.er uses in western Colorado. <br />(j) "C. f. .')." mean!'; cubic feet of wa.ter per second of time. <br />2. The ARpen Reservoir shall be constructed and maintained on the Roaring <br />Fork River above t,he town of Aspen, Colo., with an active capl1city of about <br />28,000 Il.Cre-fe-ct and with a reasonable cxpecta.ncy th\\.t it 'l.'iH m~ a.nnuaHy. 'fhe <br />28,000 Acre-.feet of water stored therein shall be available for replacement purposes <br />in "':eetern Colorado. All of such stored water .':lhall be released under thc condi- <br />tions and limitat.iolls hereinafter set forth. <br />3. The cost of construction and perpetual operat.ion and maintenance of t.he <br />Aspen Reservoir shall be a charge against the pmject and ghaH be paid from <br />project revenues or as otherwise provided by t.he COllgress of the United States. <br />. 4. The Aspen Reservoir shall be completed before any water is diverted to <br />eastern Colorado by means of the project. <br />5. The primary purpose of Aspen Reservoir is to furnish, in like manpcr as if <br />the project were constructed by a Wilot'eT con5t::T'9.ncy di"t.rict organized pursuant <br />to the laws o{ the State of Colorado, the water required for t.he protectioll of <br />west.ern Colorado water user::; by the provisions uf section 1, chapter 192, Colorado <br />Session Laws, 1943, reading as {ollows: ('Provided, howeller, That any 'Works or <br />.facilities planned Bnd designed for the exportation of water from the natural <br />bMin of the Colorado River ft.nd its t.rihutaries in Colorado, by anv district created <br />.under th-is chapt.t~r. shall be subject. to the pro\-isions of the Colo~re.do River c.Om~ <br />plloCt. and the Boulder Canyon Project Act, as amended; that any such works <br />or facilities shall be designed, constructed, and operated in such a. manner tha~ <br />the present appropriations of water, and in addition thereto pro:;pect.i\.e u~etl <br />'of ....&.ter for irrig8tion a.nd other bl)nefic\8\ CO\l:>\lUlTJt:i.vlH.l::'C pllrpo~e~, inrlud\nj::t <br />consumptive uses for domestic, mining, and indust.rial purposes. within the nat.ura.l <br />basin o{ the Colorado River in t.he Stat.e of Colorado, from whiel' water j,... export.ed, <br />ftlll not be impaired nor incre8sed in co:<;t. at. t.hp. f'''{pp.n~e or the water m,cr:; wit.hin <br />tbe.slIiJ Ilatural basin; and that the facilit.ies and other means for the accomplisl~- <br />ment of said purpose shall be incorporated in, and made a part of, any'project <br />plans for the exportation of water from said nat.ural basin in Colorado." , <br />
