<br />struction cnd operation and water surfaces of pro-
<br />ject reservoirs will be open to the public for recrea-
<br />tional purposes, excepting those areas reserved by
<br />the operating agency,

<br />13, The project will be operated in such a man-
<br />ner that those in eastern Colorado using project water
<br />imported from the Colorado River Basin for domestic
<br />purposes shall have preference over those claiming
<br />or using water for any other purpose.

<br />. 14. The project is to be operoted in such a ma!'.
<br />ner as to secure the greatest benefit from the use
<br />and reuse of imported proiect waters within proiect
<br />boundaries in the State of Colorado.

<br />18. No transmountain diversion of water shall
<br />ever be made through the collection and diversion
<br />system of the Fryingpan.Arkansas proiect in excess of
<br />the quantitative limitations and conditions established
<br />by th;s document, PROVIDED, HOWEVER, That when,
<br />under the laws of the State of Colorado, there may be
<br />additional water available for such collection and di-
<br />version which is not ot the time of diversion required
<br />for beneficial use in western Colorado or for filling
<br />interstate water compact agreements, then such
<br />water may be colfected and diverted for beneficial
<br />use ;n the Arkansas Valley, PROVIDED, FURTHER, That
<br />such additional diversion shall only be made with
<br />the mutual consent of each of fhe following agencies
<br />of the State of Colorado, to wit: the Colorado Water
<br />Conservation Board, the Southwestern Water Con-
<br />servation District, the Colorado River Water Conserva-
<br />tion District, and the Southeastern Colorado Water
<br />Conservancy District.

<br />19, To assure project operation in conformity
<br />with the operating principle heretofore stated, to
<br />provide a means for the collection and interchange
<br />of information, and to provide a method for the con-
<br />tinued study of project operations to the end that,
<br />if the stated operatin.g principles may be improved
<br />upon, recommendations for changes may be made
<br />to the contracting parties, a commission sholl be
<br />created in on appropriate manner to be composed of
<br />one representative of the Southeastern Colorado
<br />Water Conservancy District, one representative of the
<br />Colorado River Water Conservation District, two
<br />representatives of the United States, and one repre-
<br />sentative of the State of Colorado appointed by the
<br />Colorado Water Conservation Board after consulta-
<br />tion with the Colorado Game and Fish Commission.
<br />The powers of. such commission shall be limited to
<br />the collection of data, the making of findings of fact,
<br />and the suggestion of changes in operating principles.
<br />
<br />These operating principles shall be deemed to
<br />have amended and take the place of those operating
<br />

<br />principles signed and executed on April 30, 1959,
<br />These operating principles shall be and do constitute
<br />o contract belween the signatory parties, and sholl
<br />inure to the benefit of and shall be and remain bind-
<br />ing upon said parties, their respective successors and

<br />FRYINGPAN.ARKANSAS PROJECT
<br />

<br />
<br />The Fryingpan-Arkansas project, Colorado, is a
<br />multiple purpose proiect authorized by the Act of
<br />August 16, 1962 (76 Stat, 389). The project involves
<br />transmountain diversion of water, thus requiring
<br />features on both the east and wesl slopes of the
<br />Continental Divide, Surplus waler from the Colo-
<br />rado River Basin will be diverted for use in the
<br />Arkansas River Basin in Colorado. The imported
<br />water, together with regulation of native Arkansas
<br />River waler, will provide supplemental irrigation sup-
<br />plies, municipal and industrial water, and permit
<br />power generation. Flood control will be provided by
<br />the terminal eastern slope reservoir on the Arkonsas
<br />River immediately above Pueblo, Colorado. The pro-
<br />ject will be operated and maintained by the United
<br />States in accordance with operating principles con-
<br />tained in House Document 130, 87th Congress.

<br />Pursuant to the Project Authorizing Act, con-
<br />struction of the single-purpos.e municipal water con-
<br />veyance works by the United States will be under-
<br />token (a) only in fhe event the Secretary of the In-
<br />terior finds that it would be infeasible for the com-
<br />munities involved to undertake such construction, and
<br />(b) after the execution of contracts assuring repay-
<br />ment of the cost of construction with interest within
<br />50 years..

<br />Construction of the project ;s currently estimat-
<br />ed to cost $169,905,000 including the eslimated
<br />$14,661,000 cOst of municipal and industrial water
<br />conveyance s.ys.tems, The Authorizing Act authorized
<br />the appropriation of $170 million for construction of
<br />the project. This amount is s.ubject to adjustment to re-
<br />flect fluctuations in construction cost os indicated by
<br />engineering cost indexes applicable to the 1ype::. of
<br />construction involved.
