<br />_n_ -_.-o-u~.. ~ .~u~_~ ......,...u~....~.u.... ......UIl~J 1'.....""., <br /> <br />. <br /> <br />. <br /> <br />.' <br /> <br />3425 <br /> <br />"The Bureau's decision was a travesty of justice," 110 <br />Board President Lloyd Allen said, "Our Board is <br />unanimous in its resolve to fight this outrage as far and <br />as long as it needs to go," <br /> <br />If the objection is denied, 110 can appeal to the <br />Secretary of the Interior and then go back to federal <br />court for an independent and impartial determination, <br />Meanwhile, the amount of water delivered to 110 <br />remains unchanged because there is a preliminary <br />injunction in effect. <br /> <br />Bureau's part 417 process evaluation of liD's water <br />order began after an unsuccessful attempt to reallocate <br />the California entitlement for water earlier this year. <br /> <br />U,S, District Court Judge Thomas Whelan granted liD's <br />petition to restore 300,000 acre-feet of Colorado River <br />water, which the Bureau attempted to cut from 110 and <br />give to junior right holders, <br /> <br />The judge ordered the Bureau to make the process it <br />used to review liD's water use fair, No other California <br />or Lower Colorado River Basin water diverter has ever <br />had its water use similarly analyzed or cut. <br /> <br />In its brief, 110 argues, "The Bureau, MWD (Metropolitan <br />Water District of Southern California) and CVWD <br />(Coachella Valley Water District) expert reports are <br />replete with errors, inconsistencies and omissions that <br />would have been revealed by cross-examinations," <br /> <br />The Bureau denied liD's request for a hearing and the <br />right to cross-examine witnesses, <br /> <br />Among other things, liD's objections point out the <br />Bureau's failure to consider environmental compliance, <br />mitigation and cost. 110 argues that the Bureau "used <br />speculative modeling" rather than actual data to draw <br />conclusions about water use efficiency in the District. <br /> <br />http://www.iid.comlpressbox/press.read. php3?which= 381 <br /> <br />... ....0"" *"....~ oJ <br /> <br />8/7/2003 <br />
