' <br /> <br />. <br /> <br />. <br /> <br />3423 <br /> <br />What are the next steps in this process? <br /> <br />. <br /> <br />Under the process ordered by the Court, the Imperial Irrigation DIstrict has 30 days <br />in which to provide any comments or objections to the Regional Director's Part 417 <br />determination, and may request that the Regional Director reconsider his decision. <br />In any request for reconsideration, Imperial may submit additional materials <br />responding to the data and technical analyses contained in the determination, If <br />Imperial does not seek reconsideration, the Part 417 determination will become final <br />in thirty days from tbe date of issuance, <br /> <br />. <br /> <br />In the event that Imperial does seek reconsideration by the Regional Director, the <br />Regional Director will review any written submissions from liD and issue a <br />determination regarding any written comments and objections by lID. Following <br />this reconsideration by the Regional Director, Imperial Irrigation District may, if it <br />is still dissatisfied, appeal the Regional Director's Part 417 determination directly to <br />the Secretary, Imperial Irrigation District will have thirty days from the date on <br />which tbe Regional Director issues any decision on a request for reconsideration to <br />file an appeal with the Secretary, Once the Secretary issues a decision on any <br />appeal by Imperial Irrigation District, the decision will be final. <br /> <br />Could the Department's Part 417 determination also be challenged in court? <br /> <br />A final Part 417 determination will also be reviewable by Judge Whelan, Thus, a <br />copy ofthe final Part 417 determination will be filed with the U.S. District Court, <br />and any parties having legal objections to the Department's decision can bring their <br />objections to the Court, <br /> <br />. <br /> <br />The United States, at the appropriate time, will request that Judge Whelan modify <br />or lift the current inj unction to allow the Department to implement any final Part <br />417 determination on Imperial Irrigation District's water use for 2003. <br /> <br />Does this Part 417 determination apply to future years? <br /> <br />. The Part 417 determination issued pursuant to the remand and order of the U,S, <br />District applies to 2003 only, Reclamation will sbortly initiate proceedings under its <br />Part 417 regulations for considlration of water orders from all Colorado River <br />contractors for 2004, <br /> <br />Will this Part 417 determination impact the ongoing QSA negotiations in California? <br /> <br />. Each of the parties to the QSA negotiations will have to make its own independent <br />assessment of wh at impact, if any, this determination will have on the QSA <br />negotiations, This determination was made as required by the Order of the V,S, <br />District Court and is based on the technical factors identified in the Part 417 <br />regulations. <br /> <br />- END - <br /> <br />4 <br />
