S. Army Corps of Engineers overall water <br />management responsibilities. This plan is submitted with ,full recognition that <br />the waters of the Arkansas River Basin, under consideration, are fully <br />appropriated and that neither the Secretary of Army nor the United States owns <br />any water or possesses the right to use any water stored in Trinidad Lake or <br />John Martin Reservoir. Thus, we conceive of no circumstances which the <br />Albuquerque District Engineer, on behalf of the Secretary of Army, would <br />determine that excess waters exist or that reservoir storage could be <br />reallocated, as authorized in the Flood Control Act of 1944, for the purposes <br />of issuing water supply contracts. <br /> <br />11 <br />
