(
"

('

Additionally, increased M&l revenues should assure the continuing

soundness and integrity of the fiscal accounts of the ps~rnp so that

further funding of project activities will not be halted because of

project payout problems. Accordingly, the water available due to this

timing change in irrigation plan can be treated as "surplus';, and

available for N&I use under Section 6.

(2) Title III of the Hater Supply Act of 1958 (43 U.S.C. !l 390(b);

72 Stat. 297, 319) permits the Corps to establish reservoir capacity

,
I

for the specific purpose of meeting particular water supply needs. It

has the advantage of ~ermitting an interest-free ~eriod and a further

spreading of project costs. It has the disadvantage of requiring a,

post-construction allocation of costs with the consequent need for a

new resolution of the benefits and costs "hich may properly be charged

to navigation, flood control, power, irrigation and other project purposes.

Reliance on Title III would also require a determination of what

"operational changes" for nleeting municipal and industrial needs would

"seriously affect" the original"purposes of the project. Any affirmative

determination as to such serious affect would require Congressional action

before the ne.. water supply plan could go fOl'mrd. Any nee;ative deter-

mination would invite litigation insofar as other proje'ct beneficiaries

or ~effibers of the public "ere concerned.

b. The Bureau of Reclamation

(I) Bureau authority for the sale of municipal and industrial (M&I)

water under the Pick-Sloan ~\issouri Basin Program (PSMBP) is c~ntail1ed in

4
