Accordingly, the water available due to this <br /> <br />timing change in irrigation plan can be treated as "surplus';, and <br /> <br />available for N&I use under Section 6. <br /> <br />(2) Title III of the Hater Supply Act of 1958 (43 U.S.C. !l 390(b); <br /> <br />72 Stat. 297, 319) permits the Corps to establish reservoir capacity <br /> <br />, <br />I <br /> <br />for the specific purpose of meeting particular water supply needs. It <br /> <br />has the advantage of ~ermitting an interest-free ~eriod and a further <br /> <br />spreading of project costs. It has the disadvantage of requiring a, <br /> <br />post-construction allocation of costs with the consequent need for a <br /> <br />new resolution of the benefits and costs "hich may properly be charged <br /> <br />to navigation, flood control, power, irrigation and other project purposes. <br /> <br />Reliance on Title III would also require a determination of what <br /> <br />"operational changes" for nleeting municipal and industrial needs would <br /> <br />"seriously affect" the original"purposes of the project. Any affirmative <br /> <br />determination as to such serious affect would require Congressional action <br /> <br />before the ne.. water supply plan could go fOl'mrd. Any nee;ative deter- <br /> <br />mination would invite litigation insofar as other proje'ct beneficiaries <br /> <br />or ~effibers of the public "ere concerned. <br /> <br />b.
