LundquIst, asking whether <br />agency interprclations of the provision .ire <br />overly broad. Robert D. Thornton then ex- <br />amines section 10 incidental permits and the <br />Habitat Conservation Planning process. This ar- <br />ticle makes clear the financial burden placed <br />on individuals where private land use threatens <br />endangered species existence, Peter H. Evans <br />then explores an interesting multijurisdic- <br />tional, river-based species and habitat mitiga- <br />tion protection program for endangered <br />Colorado River fish. <br />In a comprehensive article by J,B. RuhI the <br />section 4 species listing and habitat protection <br />processes are detailed. Eileen Sobeck dis- <br />cusses the criminal and civil liabilities that could <br />result for failure to comply with the Act. Carlo <br />A. Balistrlerl examines international issues in <br />endangered species conservation. <br />As evidenced by the foregoing articles, sig- <br />nificant controversy surrounds the interpreta- <br />tion and implementation of the Endangered <br />Species Act. This issue is debated in a pointed <br />"point-counterpoint" between Wm. Robert <br />Irvin and Michelle Desiderio, both of whom <br />suggest means by which to establish a better <br />program for endangered species protection in <br />the upcoming reauthorization of the Act. Fi. <br />nally, a special feature in this issue is a bibli- <br />ography of recent books and law review articles <br />prepared by Kristin A. Cheney discussing en- <br />dangered species protection. <br />As even a cursory review of this issue of <br />NR&E reveals, there is significant debate con. <br />cerning both the policy and substance sur- <br />rounding implementation and reauthorization <br />of the ESA. Sound conservation planning, based <br />on population and ecosystem ecology, must be <br />implemented to assure the existence of endan- <br />gered species over time. This may take enor- <br />mous tracts of land and water as wi[h the <br />Northern Spotted Owl and Colorado River fish, <br />or small parcels as with the Perdido Key Beach <br />Mouse, Reauthorization must recognize the ec- <br />ological basis for species preservation, better <br />integrate preservation objectives with land <br />planning, and more fairly reward land owners <br />for their participation in achieving this impor- <br />tant national goal. <br /> <br />Robert D.
