<br />115 <br /> <br />'- <br /> <br />it is recognized that it requires a general co-ordination and co- <br /> <br /> <br />operation of all the Western States to bring about the greater <br /> <br /> <br />development upon this river. The thought is that the Upper States <br /> <br /> <br />have no dis?osition to retard the earlier development below, pro- <br /> <br /> <br />viding they have assurances that after they have co-operated in <br /> <br /> <br />bringing about that development, they lull not be thereafter pen- <br /> <br /> <br />alized, as they have been on other rivers. In that respect, it <br /> <br /> <br />would be a protective clause for us. Unless sarno such protection <br /> <br /> <br />clause is adopted, we are put in a position of constant exposure <br /> <br /> <br />to attacks from below, whether they are justified or not. Most <br /> <br /> <br />of those inter-state attacks have been prompted by political mo- <br /> <br /> <br />tives and very unfortunate in their effects upon the States in- <br /> <br /> <br />volved. <br /> <br /> <br />MR. HOOVER: I ,was going to ask this. We have the declaration <br /> <br /> <br />of the Supreme Court requiring an equitable division of the \oIater. <br /> <br /> <br />This is a distinct limitation of states rights. If we were to find <br /> <br /> <br />that there was insufficient water in the Colorado River with which <br /> <br /> <br />to meet the uses of the State of Colorado and all the States below, <br /> <br /> <br />would not Colorado be limited under the decision ,of the Supreme <br /> <br /> <br />Court? <br /> <br /> <br />MR. CARPENTER: If it ,were true that Colorado did in fact in- <br /> <br /> <br />tend to utilize and consume that Hater 'lho11y lIithin her borders, <br /> <br /> <br />then the Court might say: You must yield some for the lOHer <br /> <br /> <br />country. Furthermore, even if by her action she were to consume <br /> <br /> <br />more than a reasonable portion of her l-later supply of that river <br /> <br />W. <br /> <br />'\.. <br /> <br />'-,' <br /> <br />'- <br />
