I am moved to/speak because this is <br /> <br />a compact commission created b,y seven states for the purpose of <br /> <br />. <br /> <br />proceeding with the future disposition of the waters of the Colo~ <br /> <br />rado River, in mass, bet1-Teen the states as sovereignties. <br /> <br />Strange as it may seem to some, under our form of GoiTernment, <br /> <br />Vlhen consent of Congress was given the seven States to enter into <br /> <br />an agreement respecting the Colorado River, they vTere in that <br /> <br />respect restored to their full inherent sovereignty as independent, <br /> <br />states (12 Peters 725). So that, Vlhatever theories some may have <br /> <br />or those representing various departments may entertain, as to <br /> <br />what the law is or ought to' be, I maintain that, in this discus- <br /> <br />sion, we are meeting as representatives of sovereignties, the <br /> <br />. <br /> <br />legal attributes and p01-1erS of Vlhich are those defined by the <br /> <br />. <br /> <br />Constitution and the construction of that instrument by the Supreme <br /> <br />Court of the United States. A discussion of these authorities <br /> <br />vTill be found appended to the official report of my statement of <br /> <br />June 4, 1921 made before the House Judiciary Committee in re House <br />Resolution 6821, (serial 6), and need not here be further contin- <br /> <br />ued. <br /> <br />The states, except for regulation of interstate 'commerce <br /> <br />. <br /> <br />and international obligations, have alv~ys been declared and con- <br /> <br />strued to have control over the navigable and non-navigable waters <br /> <br />. <br /> <br />Vlithin their'borders. <br /> <br />w. <br />
