<br />.. <br /> <br />Meeting Summary: <br />Texas 'lVaier Bank <br />Informal Draft Rules Di5a.Jssion <br />January 27, 1994 <br />AJJstin, Texas <br /> <br />p.j, 1:30 pm, lV\OB Executive Administrator Craig Pedersen called the infom1al meeting to order <br />to discuss the draft rules for the water bank. EA Pedersen noted the presence of Representative <br />Jerry Yost as well as other interested attendees and thanked everyone for their attendance. He <br />indicated that the 1'MJB had attempted to seek extensive public input in the drafting of the bank <br />rules and was confident that the effort would yield a product reflective of everyone's concerns. <br />He thentumed the disaJSSion over to 1'\t\OB bank manager Dan Beckett for more detailed <br />explanation of the draft rules. M". Beckett indicated that he had spoken to Mr. Tommy Hebert <br />of the lCM'er Neches Valley Authority by phone and that possibly turnout from the Gulf coast <br />areas might be limited due to severe weather conditions in the I-bJston area. He then reiterated <br />his welC01T1Ei to those in attendance. <br /> <br />Mr. Beckett then summarized the activities to date, emphasizing the meetings that were held in <br />McAllen, \/idoria, and Lubbock and the resulting product of those meetings, namely, the draft <br />rules under disaJSSion today. He then briefly sul1YlWized the rules, going one section at a time, . <br />answering questions and providing insights where possible. He pointed out that the definition of <br />water rights, as used in the rules, was somewhat more expansive than what is nom Ially thought <br />of in the nom Ial conduct of water rights activities, and also includes water and ground water. <br />Items of interest were noted for future resolution berae publication c:A the rules. Those items <br />included: <br /> <br />. The need to address the possibility that a water right could include the right to storage <br /><:aI~ in a reservoir. <br /> <br />. The effect of the use of a deposited water right by its 0Nner on the availability of the right <br />remaining for plJIctase. <br /> <br />. The responsibilities c:A the lVI.OB in regard to providing info.l, .ation about rights on deposit <br />to prospective buyers <br /> <br />. The status of a right, with regard to cancellation plOceedings, which has been proposed <br />for deposit but not yet accepted into the bank. <br /> <br />. The meaning c:A the language concerning consistency with the Texas Water Plan. <br /> <br />. The need for a pi ocess to allON the appeal of decisions by the adninistrator with regard <br />to the acceptance c:A deposits into the bank. <br /> <br />. The approach necessary to adequately evaluate third-party in.pacts associated with the <br />transfer of ground water. <br /> <br />. That the conseMItion of water and ensuing deposit could possibly lead to more than 50% <br />of a right being deposited in the bank. <br /> <br />7 <br />
