The following guidelines are proposed for negotiatir:g <br />scenic easements: <br /> <br />1. Scenic easements would not: <br /> <br />a. give the public the right to enter upon the property for any <br />purpose. <br /> <br />b. deny the right of the landowner to use the area for general <br />crops. livestock farming, and gardening. <br /> <br />c. affect bny recular use exercised prior to the acquisition of <br />the easement without the OImer I s consent. <br /> <br />. d. affect the right of a landowner to sell his land or the right <br />of his heirs to inherit the lund. <br /> <br />e. affect the ri8ht of the lando;,ner to perfonn maintenance on <br />all existing roads, slructur~s and buildings and the right to <br />replac". c-ebuild ~: substitute <lny r02d, 'cu~lc:!..ng or structur" <br />now existing uith similar ro",ds, buildings or structures in <br />substantially the same locations. <br /> <br />Scenic easements would: <br /> <br />a. exclude industrial activity except for prior established uses. <br /> <br />b. require that the easement area be kept in a neat and orderly <br />condition with no garb~Be, trash, cr other unsightly material <br />allowed to accumulate. <br /> <br />c. <br /> <br />require that the general topography be maintained in its present <br />condition unless changes nre approved by the Forest Service. <br /> <br />d. <br /> <br />prevent unattractive or nonperr.nnent structures from being <br />moved into the easement area. <br /> <br />-5- <br />
