Providing the water from other sources will be the <br />responsibility of the Recovery Program and will occur in accordance with the <br />following process: <br /> <br />A. Once instream flow needs have been identified. the Oversight Committee <br />will request from staffs of the appropriate State agencies and other Oversight <br />Committee members recommendations on the physical and legal means for <br />providing the desired instream flows. The alternatives will be provided by <br />these parties to the Oversight Committee. along with estimates of costs. <br />methods of implementation, time frames, and procedural requirements. <br /> <br />B. The Oversight Committee will review the available alternatives, prepare <br />recommendations, and implement the recommendations through cooperative efforts <br />under the Recovery Program. The Oversight Committee will subsequently monitor <br />the efforts of all parties to ensure that the instream flows are achieved. <br /> <br />C. The Recovery Program will not attempt to acquire water rights by <br />condemnation. nor acquire rights from other than willing sellers. <br /> <br />D. Instream flows will be administered by the respective State Engineers <br />and tribal authorities pursuant to state and tribal laws. <br /> <br />3.2.3.3 <br /> <br />LeGal Protection of Instream Flows <br /> <br />The success of this recovery program is contingent upon the legal protection <br />of water for instream flows pursuant to Federal. State and tribal laws. The <br />manner in which this will be achieved by the States of Colorado, Utah, and New <br />Mexico is described in Appendices 1 through 3. <br /> <br />3.2.4 Potential Sources of Water <br /> <br />Identification of instream flow needs and potential sources of water to meet <br />those needs will be conducted on a S;t.-specific basis. <br /> <br />15 <br />
