Authority for receiving such
delegation exists in both 40 CFR 52.21(u) and in Section 25-7-201 through 210 of
the Colorado Air Quality Control Act.

The primary reason for seeking such authority is a desire to unify permitting .
procedures so that businesses located in Colorado will only be subjected to one set
of air quality regulations.

A number of aCtions relating to delegation have already been taken by the Air
Pollution Control Division. On March 22, 1982, a letter was sent to the EPA
Regional Administrator aSking for interim authority to administer the PSD program.
Subsequent to that, on April 22, 1982 the Colorado Air Quality Control Commission
accepted a draft for public hearing purposes of the proposed revisions to
Regulation No.3, which adds a new PSD section. A public hearing is being
considered for mid-October, 1982. Additionally, the PSD Task Force formed in
September, 1981, is still providing direct input into the preparation of the final
PSD regulation.

-28-
