<br />143t\ <br />the State Historical Preservation Office (Preservation Office). If such properties are <br />identified, the Preservation Office must be consulted by the agency applying National <br />Register criteria to ascertain whether the properties may be eligible for inclusion on the <br />National Register of Historical Places. If the federal agency and Preservation Office agree the <br />property is not eligible for the National Register, the federal agency needs to take no further <br />action with respect to the property under Section 106. If the parties agree that the property is <br />eligible, the federal agency proceeds with the process set forth in the Regulations. If they <br />disagree or if the Advisory Councilor Department of Interior requests, the federal agency <br />may see a formal determination of eligibility from the Keeper of the National Register, a <br />National Park Service official. <br /> <br />Administration of the program identifying cultural resources for Colorado is done through the <br />offices of the Colorado State Historical Society (CSHS). Further information on the Advisory <br />Council, the CSHS, and cultural resources in the project areas is given in the Cultural <br />Resources Report. <br /> <br />u.s. Forest Service <br /> <br />The USFS must approve plans and specifications for all projects as they relate to the National <br />Forest Service system lands, as well as roads, trails and other transportation facilities that <br />may be required for a water project. Permits from the USFS may include: Special Use Permit, <br />Forest Plan Consistency Determination, Land Tenure Adjustment Permit, and Timber Sale <br />Contract permit. Special use permits are required for any occupancy or use in the National <br />Forest System lands by private interests. The Special Use Permit requires an EA and/or an <br />EIS. An authorization is needed to gain access across lands or for construction of facilities on <br />USFS lands. <br /> <br />As there are no USFS lands around Pueblo Reservoir, Lake Meredith or the proposed gravel <br />lakes sites. The USFS would only require permits for the Turquoise Reservoir enlargement <br />and Project reoperations as they pertain to Turquoise Reservoir and Twin Lakes. The USFS is <br />particularly concerned about inundation of campgrounds, boat ramp, utilities and abandoned <br />mine sites around Turquoise Reservoir. In addition, the potential loss in value of facilities due <br />to fluctuating lake levels at both Twin Lakes and Turquoise Reservoir and increased flows <br />through Lake Creek are a concern regarding the project reoperations scenario. <br /> <br />The USFS has district offices in Leadville, Salida and Pueblo and an office in Lakewood. The <br />Leadville office will be the main point of contact. <br /> <br />u.S. Bureau of Land Management <br /> <br />The BLM has the responsibility for issuing Right-of-Way and Temporary Use Permits under <br />the Federal Land Policy and Management Act. This is done through the Application for <br />Transportation and Utility Systems and Facilities on federal lands. This Right-of-Way and <br />Temporary Use permit covers all applications, grants, permit amendments, assignments and <br /> <br />~ <br /> <br />6 <br /> <br />Permitting and Regulatory Issues <br /> <br />~. <br />
