<br />QQ('Z61 <br /> <br />November 8, 1943 <br /> <br />REPORT ON THE A!l1INISTRA'fION OF TIlE ARKANSAS RIVER <br />UN DER <br />THE COUlRADO-KANSAS STIPULATION OF 1933 <br /> <br />Prior to the initiation of administration of the Stipulation, <br /> <br />the Sto.te i;ngineer of Colorado conferred with representatives of the At- <br /> <br />tOl'ney General's office and Counsel for the Arkansas Valley Ditch Asso- <br /> <br />ciation first on February jrd, and subsequently at other times. Other <br /> <br />conferences between the officials of Colorado and of Kansas were held to <br /> <br />conside," questions relatinc; to interpretations of the provisions of the <br /> <br />Stipulation and administro.tion. The last conference was held on August <br /> <br />19th betw3en the Attorneys General of Colorado and Kansns, the two State <br /> <br />Engineers, COlL'lsel for the Arkansas Valley Ditch Association and other <br /> <br />ditches, and represerrt"ti ves of the Colorado Water Conservation Bonrd. <br /> <br />At the sever"l meetings of the Colorado representatives, it was the co~- <br /> <br />sensus of opinion ~hat tl~ Stipulation posed many originnl and involved <br /> <br />questions of admini stration not tmretofore presented, which called for <br /> <br />the e::ceroise of tolerance and patience on the part of the water users <br /> <br />pending the forthcoming decision of the Supreme Court of the United States <br /> <br />which would deterlaine future administrative procedure. It was also the <br /> <br />consensus of opinion at the ear ly conferences, toot due to the involved <br /> <br />cl~racter of conflicting interests, it v~uld be necessary that the State <br /> <br />Engineer of Colorado exeroise his discretion in meeting many problems as <br /> <br />they arose from time to time. tlr.
