Director. <br /> <br />SUBJECT: 1974 Land Use Legislation. <br /> <br />During the recent session of the Colorado General Assembly <br />there was enacted and signed into law House Bill No. 1041. relating <br />to the use of land (Article 7. Chapter 106. CRS 1963. as amended). <br />Pursuant to the provisions of the act. local governments may designate <br />certain areas of state interest from among the following: <br /> <br />a. Mineral resource areas. <br /> <br />b. Natural hazard areas. <br /> <br />c. Areas containing. or having a significant impact <br />upon. historical. natural or archaeological <br />resources of statewide importance. <br /> <br />d. Areas around key facilities in which development <br />may have a material effect upon the facility or <br />the surrounding community. <br /> <br />Among the natural hazards listed in the act are floodplains. <br />A floodplain is defined in the act as being "an area adjacent to a <br />stream. which area is subject to flooding as a result of the occur- <br />rence of an intermediate regional flood and which area thus is so <br />adverse to past. current. or foreseeable construction or land use as <br />to constitute a significant hazard to public health and safety or to <br />property." <br /> <br />With reference to the administration of floodplains. the <br />act provides as follows: <br /> <br />"Floodplains shall be administered BO as to minimize <br />significant hazards to public health and safety or to <br /> <br />co 1...\:' ~ <br />
