Walker <br />Depuly Director <br /> <br />SUBJECT: Releases by the State of Colorado from Bear Creek Lake <br /> <br />Attached hereto are the estimated releases that the CWCB <br />would anticipate making from Bear Creek Lake. These releases <br />are made pursuant to the combined stipulation for cases, <br />88CW95. 88CW94. 84CW168. 84CW167. 84CWl15. This stipulation <br />generally defines the priorities for using water originally <br />decreed in 79CW306 and W-232 as follows: <br /> <br />1) Maintenance of the permanent pool in Bear Creek Lake <br />including the replacement of evaporative losses from <br />the permanent pool and any necessary carryover. <br /> <br />2) Second. toward municipal. domestic and irrigation uses <br />associated with recreational development at Bear Creek <br />Lake. but not to.exceed 250 a.f. of gross diversions <br />annually. <br /> <br />3) Replacement of evaporative losses at Cherry Creek <br />Reservoir if such is physically and legally possible. <br /> <br />4) The State shall allocate annually the remainder. less <br />any carryover required for 1-3 above. to entities that <br />as of February 1 of that year are permitted to store in <br />Bear Creek Lake if those entities have space available. <br /> <br />As no evaporative losses from Bear Creek Lake occurred in <br />the study periOd identified (Lake did not exist) the assumption <br />is made that evaporative losses are equal to the average annual <br />net evaporation rates. <br /> <br />The release pattern identified assumes that the state will <br />use a significant portion, if not all. of its interests in the <br />Simonton Ditch (Bear Creek priority 2) to satisfy the state's <br />obligation for evaporation replacement at Bear Creek Lake each <br />year. The storage water rights the state owns will be used to <br />maintain the existing permanent pool in Bear Creek Lake, any <br /> <br />1694E" <br />
