(1) When the Department receives a conservation awl1cation the Director
shall make the followi.n;J evaluation:

(a) Whether the =nservation p~ will result in a :reduoed
diversicn.
(b) Whether the o:nsel:Vation p2:'C:lpOOal will not adversely affect
exi..stiIB'1IIater rights or the ~lic interest, as des=ibed in ORS
537.170 (5); and,
(c) Whether 25 percent of conserved water is the a~ropriate anount
to all=ate to ~lic use. 'Ihe criteria the Director shall use in
maki..ng a reo ""'-rxlation c::onoerniIq the allocation of conserved
water are listed in OAR 690-18-050 (6) (b) (A) (i) through (vi).

(2) 'Ihe Director shall pro<Ti.de ~lic notice of all =nservation
awlications and prelilninary evaluations thrI:AJgh:

(a) Publication in a I'lE!'WSpilper haviIB' general c:ira..1lation in the area
in which the water rights acXIressed in the proposal are located,
for a periOO of at least three weeks and not less than one
pJblication each week; ani,
(b) MailiIB' notification to in:lividuals, organizations ani agencies on
the OAR 01apter 690 Division 1, ani Division 11 mailing lists, to
any person who has requested notificaticn of proposals and arrj one
else the Director detennines shccld be notified.

(3) If an oojectian is received I::rj the Department within 30 days of the
mailing of ~l1c notice or the first pJblication unier (2) (a) above ,
the Director may work with the awlicant am arrj person or agercy
raising the oojectian to determine whether the issues can be resolved
