1) The implementation of ORS 537.455 to 537.500 and 537.540 (2) and (3) is
a means of prcxroting lIDre efficient use of water while increasing
streamflows where p.lblic benefits can be enhan::ed. These rules are
:interrled to eI'1COOrage the highest and best use of water by all~ing the
sale or lease of the right to the' use of =nserved water.

2) An analysis of past water use is J""""OC'~;rry to evaluate the
effectiveness of a conservation measure. A lack of detailed use records
will not autaratically delay the processing of a =nservation
application, hut the O:Imni.ssion may require a pericxi of data
=llection by the awlicant prior to implenentation to establish a
baseline for evaluating the effectiveness of the measures.

3) The O::mmission recognizes that the potential to conserve water an:l. the
benefits iran water conservation may vary with each proposal. These
rules establish a process to review and evaluate the merits and impacts
of conservation proposals. After a sufficient number of awlications
are sul:Ini.tted, these rules shall be reviewed and revised, if l""""''''~a:r:y,
to further prarote efficient water use.

4) It is the intent of these rules to maintain and protect the irrigated
agricultural base by al1~ing conserved irrigation water to be used to
roeet the needs of the right holder.
