Legislative Proposals <br /> <br />1. Legislative discussions are underway for the 1991 <br /> <br /> <br />session. One idea is to simplify the process by focusing <br /> <br /> <br />the definition of conserved water on reduction in the <br /> <br /> <br />amount of water diverted. Tossing out "water <br /> <br /> <br />consumption" and "water that is irretrievably lost" as <br /> <br /> <br />the basis of conservation may frequently threaten to <br /> <br /> <br />harm other users, but would provide greater incentive <br /> <br /> <br />for the water right holder and greater ease of <br /> <br /> <br />administration. <br /> <br />2. A second change to go along with reliance on reductions <br /> <br /> <br />in diversion would be a fixed split of 50 percent of <br /> <br /> <br />conserved water to instream use and 50 percent to the <br /> <br /> <br />water right holder. <br /> <br />3. Both recommendations are likely to meet with <br />opposition.
