Section 321 of the Water Resources Development Act of <br />1990 requires recovering the costs of services provided to Federal <br />agencies, private persons and organizations. Section 404 of the Clean water Act prohibits <br />discharges of dredged or fill materials into waters of the United <br />States, including wetlands, without a permit from the Corps of <br />Engineers, Persons or agencies who are planning to do filling or <br />excavation activities in any waterway should contact the Corps of <br />Engineers office in Pueblo, Colorado, In 1997, we issued 11 <br />individual permits in the Arkansas River basin. An additional 275 <br />activities in the basin were reviewed during the period and most <br />were covered under nationwide permits. Several major regulatory <br />events happened in 1997 which affect the Arkansas River basin. All <br />of the nationwide permits expired in early 1997 and were then <br />reissued for another 5 years; some with significant changes, <br />Nationwide Permit No. 26 for work above the headwaters (the "1- <br />acre" permit) had major changes. It was downsized from 1 acre to <br />1/3 acre, a written after-construction report to the Corps is now <br />required. This nationwide permit will permanently expire in <br />December 1998. New nationwide or regional permits will be issued <br />in the next year to take the place of this widely used permit, The <br />proposed listing of an endangered mouse in El Paso County added <br />complications to 404 permits in the Colorado Springs and Monument <br />metro areas. Trapping surveys were sometimes required to determine <br />if the project could go ahead without changes.
