<br />I <br /> <br />SI <br />, <br />,I <br /> <br />Colorado Ute Indian Water Rights Final Settlement Agreement of <br /> <br />December 10, 1986, and the Stipulation for a Consent Decree filed <br />in Colorado District Court for Water Division No. 7 on behalf of <br /> <br />the Southern Ute and Ute Mountain Ute Indian Tribes, Case No. W- <br /> <br />1603-76B, includes an administration agreement in which the par- <br /> <br />ties reached a compromise on the administration of the tribes' <br /> <br />reserved water rights within the exterior boundaries of the <br /> <br />tribes' reservations. This agreement gives the State Engineer <br />primary administrative responsibility over all waters apportioned <br /> <br />to the tribes at the points of diversion located on the San Juan <br /> <br />'~ <br /> <br />River and gives the tribes primary administrative responsibility <br /> <br /> <br />over all waters within the tribes' canal distribution systems. <br /> <br />The State Engineer was also given authority to administer and <br /> <br />regulate, pursuant to state law, all non-reserved waters of the <br /> <br />tribes and all rights to the use of surface or ground water <br /> <br />within the reservations which are not part of the tribes' <br />reserved water rights. The tribes can seek additional water <br /> <br />'f <br /> <br />rights by appropriation in accordance with and pursuant to state <br /> <br /> <br />law. <br /> <br />It is anticipated that the State of Colorado, the Ute Moun- <br />tain Ute Indian Tribe, and the Secretary of the Department of the <br />Interior will work together in good faith to carry out the pro- <br />tection of flows under the terms of the San Juan River Recovery <br />Implementation Program.
