<br />6 <br /> <br />Blocks 7 and 8 of NIIP - Because the Program will not have been <br />implemented at the time the consultation is initiated, specific <br />measures may be required pursuant to the Endangered Species Act to <br />offset the potential Federal action impacts which are likely to <br />jeopardize listed fish. Measures to lessen such impacts, consistent <br />with Section 7 (a)(2) of the Endangered Species Act, may consist of, <br />but are not limited to: 1) protection of reservoir storage releases <br />through the Navajo Nation; 2) NIIP modifications; 3) commitments to <br />convert water use that is currently in the baseline for the ALP to <br />other uses to the benefit of listed fish; 4) scheduling of flows below <br />Navajo Dam to provide additional water to benefit the listed fish; 5) <br />assessment of the impacts of any contaminants associated with NIIP <br />return flows on listed fish and a program to reduce any adverse <br />impacts; or (6) implementation of any of the measures listed on page 5 <br />to achieve sufficient progress. <br /> <br />Navajo South Project - Some progress under the Program is possible <br />prior to consideration of this project under Section 7 consultation. <br />Measures will likely be required to offset project depletions or other <br />potential project impacts which are likely to jeopardize listed fish. <br />Such measures to lessen project impacts, consistent with Section <br />7(a)(2) of the Endangered Species Act, may consist of: (1) project <br />modifications; (2) commitments to convert water use that is currently <br />in the baseline for the ALP to other uses to benefit listed fish; (3) <br />scheduling of flows below Navajo Dam to provide additional water to <br />benefit the listed fish; or (4) implementation of any of the measures <br />listed on page 5 to achieve sufficient progress. <br /> <br />Bluff Bench Energy and Agricultural Project - Section 7 consultation on <br />this project will likely occur prior to implementation of the Program. <br />Measures will likely be required to offset project depletions or other <br />potential project impacts whiCh are likely to jeopardize listed fish. <br />Such measures to lessen project impacts, consistent with Section 7 <br />(a)(2) of the Endangered Species Act, may consist of reducing the <br />planned full depletion level to help meet flow requirements for the <br />protection of the endangered fishes or implementation of any of the <br />measures listed on page 5 to achieve sufficient progress. <br /> <br />2. After the 7 Year Research Period <br /> <br />After the research period, definitive information should be available <br />to identify flow and other needs of the listed fish and to determine <br />the level of sufficient progress made under the Program. This <br />information is intended to achieve the goals of the Program, i.e. to <br />conserve listed fish populations while proceeding with water <br />development in the Basin. There is the option for a Federal agency or <br />project sponsor to implement measures in addition to those accomplished <br />under the Program and which would offset the likelihood of jeopardy. <br />Such measures could allow a Federal action to go forward even if <br />sufficient progress has not been made under the Program. <br />
