AIDS, <br />Under the Colorado Civil Rights Act and <br />pursuant to the Americans with Disabilities Act, <br />employees \\'ho are illY-positive or have AIDS <br />shall be treated as dis.1bled or handicapped <br />employees. Consequently, the employer must <br />reasonably accommodate that employee's needs <br />and may not discriminate against the employee. <br />B. Drug Testing, <br />Generally private employers may require <br />their employees to submit to drug tests. Cer- <br />tain governmental employers may require drug <br />testing based. upon reasonable suspicion while <br />other governmental employers may re'iuire <br />drug testing if the safety and health 0 the <br />public or national security may be affected. <br />C. Family Leave, <br />These laws generally allow a certain pe- <br />riod of leave of absence, usually without pay, <br />for a parent to care for a newborn or newly <br />adopted child or to provide health care for an <br />ill family member. Presently no such federal or <br />Colorado state requirement exists. <br />D. Sexual HarassmenL <br />A form of sex discrimination under TItle <br />VII of the 196-1 Civil Rights Act and under the <br />Colorado Civil Rights Act. <br />1. "Quid pro quo" Sexual Harassment <br />An employer (e.g., supervisor) requires <br />as a condItion ot employment that the em- <br />ployee provide sexual favors to the em- <br />ployer (suf'€'Ivisor). <br /> <br />8 <br /> <br />2. Hostile Working EnvironmenL <br />The employer allows a hostile working <br />environment to exist, e.g.. derogatory and e <br />demeaning language, jokes, pictures, <br />touching. and other similarly inappropri- <br />ate behavior. <br />VII. CONCLUSION, <br />Today's employers face a substantial amount <br />of state and federal governmental regulation.
