Sparks, Director. <br /> <br />SUBJECT: Animas-La Plata Project, Agenda Item #7, Board Meeting, <br />September 11, 1963. <br /> <br />The proposed report of the Secretary of the Interior on <br />the Animas-La Plata Project was submitted to the interested states <br />under date of October 12, 1962, for a review under the Flood Con- <br />trol Act of 1944. Under the Act the interested states are required <br />to submit their comments within a period of ninety days. <br /> <br />The ninety day period for review expired on January 12, <br />1963. Comments of the State of Colorado were submitted on January <br />3, 1963. A copy of those comments are attached hereto. The State <br />of New Mexico, however, requested an additional sixty days in order <br />to prepare its comments. This additional sixty day period expired <br />on March 12, 1963, and as yet no comments have been submitted by <br />the State of New Mexico. <br /> <br />Since the Animas-La Plata Project lies partly within the <br />State of New Mexico, the Secretary of the Interior has held up sub- <br />mission of his report to the Congress pending an official statement <br />of New Mexico's views. <br /> <br />The staff of this Board has held several conferences with <br />the New Mexico officials regarding the lack of comments on the part <br />of the State of New Mexico. On July 10, 1963, Mr. William Eakes <br />and myself met with the New Mexico officials in Santa Fe, New Mexico, <br />on the problem. ,'Ie were informed that New Mexico is still with- <br />holding comment until such time as the Secretary of the Interior <br />shall make a finding as to the availability of water to New Mexico <br />from the Navajo Reservoir. New Mexico is basing its position on <br />Section ll(a) of the Act authorizing the Navajo Indian Irrigation <br />Project and the San Juan-Chama Project which reads in part as fol- <br />lows: <br />
