<br />Chapter 9 <br /> <br />Conclusions <br /> <br />This report, prepared in compliance with Special Master, Arthur L. Littleworth's <br />order in the Kansas v. Colorado litigation, describes Colorado's current efforts and plans for <br />complying with the Arkansas River Compact and requiring augmentation to senior surface <br />water rights within the state. The efforts detailed in this report indicate the importance <br />Colorado has placed in this area to solve the critical issues facing the Arkansas River basin. <br /> <br />As detailed in this report, significant resources have been and will be acquired to <br />ensure enforcement of the 1994 Measurement Rules and the 1996 Use Rules. Those <br />resources will be dedicated towards field inventory reconnaissance and management of the <br />data required. The Division of Water Resources is committed to ensure that effective data <br />management tools are available to accomplish their mission. <br /> <br />The efforts of the Arkansas River Coordinating Committee (ARCC), as appointed by <br />Governor Romer, are to be commended. ARCC members provided considerable thought and <br />advice on the problems facing the basin. The boards of directors of LA WMA, CWPDA, <br />AGUA and Southeastern Colorado Water Conservancy District are all to be conunended for <br />recognizing the seriousness of the situation and planning for solutions that can be available <br />for 1996. <br /> <br />_ The 1994 Measurement Rules laid a foundation from which further compliance efforts <br />can be built. The promulgation of the 1996 Use Rules are the cornerstone of the state's <br />efforts to require replacement of out-of-priority depletions to senior surface water rights in <br />Colorado and usable stateline flow. <br /> <br />The State of Colorado and its water users are making significant progress towards <br />compliance with the Arkansas River Compact. The State Engineer recognizes the State of <br />Colorado's responsibilities under the Arkansas River Compact and the U.S. Supreme Court's <br />decision in Kansas v. Colorado and has been working diligently to bring post-compact well <br />pumping into compliance with the Arkansas River Compact. <br /> <br />30 <br />
