<br />. <br />. <br /> <br />C\1 <br />'ll:l" <br />;yo. <br />- . <br /> <br />..:- <br /> <br />ce <br /> <br />A principal objective of these transactions is to maximize the credit for the easement as <br />part of the $5,600,000 the CWCB has committed to the A-LP Project under the 1990 <br />Cost-Sharing Agreement between the Bureau and the CWCB. The Bureau has already <br />indicated that it may only need 18-20 acres out of the 46 acres comprising the site, <br />However, until the Bureau has finalized plans for the site, the amount of land it needs for <br />the pumping plant is unknown, In the meantime, the CWCB staff is in the process of <br />hiring an appraiser with expertise in valuation of contaminated property to conduct an <br />appraisal of the site. <br /> <br />On April 8, 1998 the board of directors of the District voted to accept the property from <br />the CWCB subject to review and acceptance of the terms of the quitclaim deed from the <br />CWCB to the District. <br /> <br />In cooperation with the District, we have made inquiries with the city of Durango <br />regarding its interest in the property. The City and the District appear to be on good terms <br />and we have not identified any conflicting or competing interests that might affect the <br />Board's consideration of this matter. <br /> <br />. <br /> <br />Recommendation <br />Staff recommends that the Board authorize the Director to accept title in the form of a <br />quitclaim deed from the Colorado Department of Public Health and Environment for the <br />46 acres, more or less, ofland located in the West Yz of Section 32, Township 35 North, <br />Range 9 West of the New Mexico Principal Meridian, as more fully described in the deed <br />from the CDPHE to the CWCB. It is further recommended that the Board direct the staff <br />to convey the property to the Animas La Plata Water Conservancy District at the earliest <br />possible time, subject to an exception for an easement to the Bureau of Reclamation for <br />the Durango Pumping Plant of the Animas-La Plata Project. <br /> <br />The CWCB, the District, and the Bureau will enter into a Memorandum of Agreement <br />(MOA) before an easement is granted to the Bureau. The MOA will include a provision <br />whereby the easement to the Bureau will result in a credit to the State of Colorado's $5.6 <br />million obligation for the Animas-La Plata Project. <br /> <br />Cc: Board of Directors, ALPWCD <br />Pat Schumacher, USBR, Durango <br />Linda Bassi, AGO <br /> <br />Attachment <br /> <br />. <br /> <br />3 <br />
