<br />. <br /> <br />. <br /> <br />DRAFT <br />9/21/95 <br /> <br />COLORADO W ATER CONSERVATION BOARD <br />RECOVERY INSTREAM FLOW APPROPRIATION OPTIONS <br /> <br />Option I - Yampa River Instream Flow Appropriation <br /> <br />Conct;pt <br /> <br />An instream flow right similar to the FWS flow recommendation is appropriated as <br />follows: <br /> <br />Runoff Months: 10% Exceedance; based on 1970-1992 adjusted flows <br />(CWCB Study) <br />Non Runoff Months: 20 % Exceedance; based on 1950-1982 virgin flows (FWS) <br /> <br />A development allowance (Carve Out I), distributed on a monthly basis, is reserved for <br />water rights junior to the ISF appropriation and is not included in the appropriation. <br /> <br />The junior water rights under the development allowance will not be called out by the <br />instream flow right until the develop allowance (Carve Out I) is used up. <br /> <br />A second development allowance (Carve Out II) is provided for development in excess of <br />Carve Out I. <br /> <br />When the first development allowance (Carve Out I) is used up on either a montWy or <br />annual basis, the Board may modify the second development allowance from instream uses <br />to consumptive uses. <br /> <br />The ISF right consists of flow in excess of the development allowance (Carve Out I). <br />and, <br /> <br />Consists of two components: <br /> <br />I) A non-modifiable portion (Paragraph 3) which consists of water that must <br />flow out of Colorado because of compact obligations, and <br /> <br />2) A modifiable portion (Paragraph 4) which maybe modified by the Board <br />
