Legal water availability was derived from preliminary information developed by <br />the Ad Hoc Endangered Fish Flow and Colorado River Compact Water <br />Development Workgroup (Workgroup) as follows: <br /> <br />Present Level of Development <br />Workgroup Projection <br />(Lower Limit) <br />Lower Limit of Total Consumption <br /> <br />= 112,800 af <br /> <br />= 51.772 af <br />= 164,572 af <br /> <br />Additional Amount Necessary to meet <br />Colorado's full Compact Development <br />Upper Limit of Total Consumption <br /> <br />· 164,572 af <br />= 173.491 af <br />= 338,013 af <br /> <br />4. Distribution of the Lower Limit of Total Consumption (an additional 51,772 af <br />annually) or the first level of compact development allowance is based on a <br />monthly water demand distribution pattern derived from the 1995 Yampa River <br />Basin Feasibility Study and outlined on the basic data sheet (Table 1c). <br /> <br />5. Distribution of the Upper Limit of Total Consumption (an additional 173,491 af <br />annually) or the second level of compact development allowance is based on a dry <br />year hydrograph derived from the Colorado River Basin Physical Water <br />Availability Study done for the Board by Leonard Rice Consulting Water <br />Engineer's and outlined on the basic data sheet (Table 1d). Water users in the <br />Yampa Basin are suggesting that only 50,000 af of the 173,491 afrecommended <br />by the Workgroup be reserved as Paragraph 4 water and distributed as outlined on <br />the basic data sheet (Table Ie). <br /> <br />Application: <br /> <br />1. The application filed will be for the Service's wet year flow recommendations <br />during the August through March period and for the 10% exceedance flows during <br />April, May, June and July as described in assumption 2 above. The Workgroup's <br />lower limit of total consumption (51,772 af annually) along with the upper limit <br />of total consumption or the remaining amount to meet Colorado's full compact <br />development (173,491 at) will be reserved for compact development purposes. <br />The upper limit may only be utilized through modification of the Board's recovery <br />instream flow water right. The intent is to allow for total depletions in the Yampa <br />Basin above the Maybell gage in the amount of 338,013 af annually. The total <br />depletions are to be distributed over the course of the year consistent with the goal <br />of maintaining a relatively natural hydrograph. The water remaining after both <br />levels of compact development have been utilized is available to satisfy the <br />recovery instream flow appropriations and may only be modified with the consent <br />of the Service. <br /> <br />2. The lower limit of total consumption (51,772 af) is not included in the Board's <br />appropriation and must be totally utilized before administration and enforcement <br />of the recovery instream flow water right is sought.
