<br />The Amily Mulual Irrigalion Company <br /> <br />1477 <br /> <br />This law is much too extensive to attempt to summarize in a report <br />of this length. Some interesting aspects of the law provide for: <br /> <br />(a.) Seven water divisions headed b)' a division engineer under the <br />state engineer, with a designated water judge and referee in each. <br />(b.) Ten years of non-user of a water right creates a rebuttable pre- <br />sumption of abandonment of the right. <br />(c.} Priorities awarded for surface rights shall be junior to all <br />priorities a warded in decrees prior to the effective date of the new <br />law; however, with respect to well priorities, if the owner shall <br />file his application notlatcrthanJul:ylJ 1971, and if it is approved, <br />his right shall be dated as of the time of his actual appropriation. <br />(d.) All decrees in each division shall be tabulated in order oC seniority. <br />These shall be llsed as a basis fora final tabulation in 1974, which <br />shall in turn be re-worked prior to Jul,y 1 of each even numbered <br />year after 1974. <br /> <br />No doubt some interesting and important decisions will be rendered <br />by the Engineer and the Courts under this new law and we must keep careful <br />tabs on the situation as it develops. <br /> <br />The case of "FelIhauer v. The State of Colorado. et al" and the re- <br />sulting Supreme Court Decision has made it imperative that the State <br />Engineer adopt rules and regulations to be applied in similar cases. <br /> <br />In concluding, we wish to again express our appreciation to the Stock- <br />holders, Directors, Officers, and Emplo,yees for the excellent cooperation <br />we have received during the past year. <br /> <br />Respectlully submitted. <br />ROBERT G.
