Does the Otizens Coalition believe that a "market-oriented" approach 'of <br />providing water to the Tribes is consistent with the United States' trust responsibility to the <br />Tribes? Please explain why, whCll the non-Indian lands md water rights that would be <br />purchased ill return for the a waiver of the Tribes' claims to water rights have not been <br />identified and the acquisitions guaranteed? <br />6. On pale 3 of the Conceptual Alternative is the statement that: <br />The Fund would be created by the feden! government ad the <br />State of Colorado, in appropriate shares, out of future legislative <br />appropriations and funds presently earmarked for project <br />purposes.. [Emphasis added.) <br />a. When would the waiver of water rights claims by and OIl behalf of the <br />Tribes be effective under the Conceptual Alternative? <br />b. What happens if the future legislative appropriations are not <br />appropriated? <br />7. On page 3 of the Conceptual Alternative is the statement that: <br />Purchases [from the Fund] would be spread out oyer a thirty <br />year period, in order to allow willlng sellen to be identified, ad <br />pl"eYent disruption of local markets. <br />a. What happens if c:irc:umstances change over the thirty year period so <br />that willing sellers ClIJII10t be identified? <br />b. What happens if purchases do diSJupt local markets and the price of <br />land and water rights iIIcreases? <br />c. What analysis,. if my, has been made to determine that the land and <br />water rights purchased from the Fund would secure for the Tribes an opportunity to derive <br />an economic benefit or generate revenue from the use of such water rights that would be <br />equal to the allocations of water that the Tribes are entitled to receive from the Animas-La <br />Plata Project under the Colorado Ute Indian Water Rights Settlement Agreement? <br />8. On pages 3 md 4 of the Conceptual Alternative is a listing of average prices <br />for irrigated land in each river basin based on an iDitiaJ appraisal of land and water sales in <br />the areas of the Southern Ute lUld the Ute Mountain Ute Indian reservations. The <br />Conceptual Alternative states: <br />This appraisal Indicated that the ac:tua1 sales price of Irrigated <br />cropland ranged from a low of $950 per acre to a high, in one <br />case. of $10,000 per acre. <br />a. Does the Citizens Coalition agree that the sales price of water rights <br />varies based on such factors as the priority, poillt of diversion, yield. historical consumptive <br />use, 'and location of use of the water rights? <br />b.
