A. 11,1. <br />August 2, <br />Page Two <br /> <br />3. <br /> <br />Gabiola <br />1982 <br /> <br /> <br />Allocations <br />The Association believes that existing customers should be afforded <br />the opportunity to re-contract for power and energy available under <br />their existing allocations (which have not lapsed). Special cases <br />may be taken into consideration so long as we are talking about <br />historic hardship cases, and not instances where previously existing <br />preference customers opted not to take advantage of the opportunity <br />to acquire federal contracts. New resources should be available for <br />marketing on an equal and equitable basis between old and new <br />preference utility customers. The current allocations have not <br />lapsed, although the contracts may soon expire. The Association <br />hopes that Western will continue to recognize that "expectancies" <br />have been created by virtue of these past allocations, and a <br />porti on of those "expectanci es" is the ri ght to execute new future <br />contracts under those allocations on "then-current terms and <br />conditions." <br />Environments and economics of local communities and regions have <br />been bui 1t wh i ch re 1y upon the all oca ti on of federa 1 power and <br />energy (and the riaht to subsequently contract therefore). There <br />is no philosophical nor legal precedent for the termination of <br />a 11 oca ti ons. <br /> <br />10 <br />
