<br />'~..!~.,~s <br />\..- "J._ ~ j <br /> <br />,. <br /> <br />COE deny the Section 404 Permit, but expressed a willingness to <br />work with the project proponents towards resolution of issues. <br />The COE has stated that it will defer action beyond the public <br />notice until Reclamation has executed this ROD. <br /> <br />The need for power was responded to in the FEIS. The Public <br />service Company of Colorado and other utilities in the area <br />project addit'ional needs in the future, with growth rates <br />projected at' ,2 to 3 percent per year over the next decade. A <br />power purchase contract has been executed between the Sponsors <br />and the Public Service Company of Colorado. <br /> <br />The UVWUA and other water groups and agencies held discussions to <br />determine a method of providing additional water in the <br />Uncompahgre R'iverthrough the city of Montrose. The low flows <br />during the irrigation season in thisS-milesectionof the river <br />were cited as an adverse impact in the FEIS and were also cited <br />in several comment letters as a significant concern. This issue <br />was' not resolved and at this time must be considered an <br />unavoidable adverse impact during the irrigation season, This <br />impact is significant from an aesthetic and fishery management <br />standpoint and has been a major concern of local citizens and <br />governments. <br /> <br />Environmental commitments made for alternative E were included in <br />the August 1990FEIS and are discussed in this ROD by reference. <br />A listing of environmental commitments are attached as Exhibit A. <br />The lease or power privilege contract will require that the same <br />environmental commitments will be included in new contractsl <br />agreements in. the event that'the Facility operation or ownership <br />or any interests in the operation and ownership are sold or <br />transferred to other parties. The lease of power privilege <br />contract will include and be conditioned On the Sponsors meeting <br />and complying1with all of the environmental commitments arid <br />monitoring requirements set rorth in the FEIS and this ROD, and <br />any other special conditions that Reclamation may determine are <br />necessary to ~nsure compliance with and enforcement. of these <br />commitments and mOnitoring requirements. In addition the <br />Sponsors must. comply with special conditions that might be set <br />forth in the section 404 Permit. <br /> <br />Commitments will be monitored by Reclamation with reports <br />provided to interested agencies. During construction, reports <br />will be provi~ed quarterly. However, once operation of the <br />Facility begins Reclamation may decide that reports be prepared <br />at less frequent intervals. The lease of power priyilege <br />contract will provide for terminating the Facility for failure to <br />adhere to environmental commitments. The lease of power <br />privilege contract will also include additional compliance and <br />enforcement provisions, such as the creation of a special <br />emergency reserve fund, Reclamation having the ability to correct <br />deficiencies and bill the Sponsors, and requirements for the <br /> <br />9 <br /> <br /> <br /> <br />-,"" <br /> <br />
