Bi 11 ings, Montana <br />-<? <br />From: .i" Regional Director, U.S. Fish and Wildlife Service, Denver, Colorado <br />, <br /> <br />Subject: Biological Opinion - Round II Water Sale from Ruedi Reservoir <br />and Green Mountain Reservoir Water Sale <br /> <br />Reference is made to the Bureau of Reclamation (Reclamation) memorandum to the <br />U.S. Fish and Wildlife Service (the Service) dated June 25, 1984, which <br />requested formal Section 7 consultation under the Endangered Species Act (the <br />Act) for Ruedi Reservoir Round II Water Marketing Program. This request was <br />accompanied by a biological assessment (Reclamation 1984) which addressed <br />impacts of this proposed action to Federally listed endangered species. In a <br />similar manner, a Reclamation memorandum dated July 2, 1985, requested formal <br />consultation and transmitted a biological assessment (Reclamation 1985) for <br />the Green Mountain Reservoir Water Marketing Program. A subsequent memorandum <br />from your Eastern Colorado Projects Office, dated March 20, 1986, requested <br />that the Service combine the Ruedi II and Green Mountain consultations so that <br />each is analyzed in one biological opinion. Five extensions of time were <br />required to complete consultation for these two sales and were agreed to by <br />the Service and Reclamation. At this time, the Service is issuing this <br />combined biological opinion for the two projects, which has been prepared as <br />prescribed in the Section 7 Interagency Cooperation Regulations, 50 CFR 402, <br />and the Act, 16 U.S.C. 1531 et seq. <br /> <br />The Service has agreed with your biological assessment's determination of "no <br />effect" on the bald eagle (Haliaeetus leucoceohalus) and peregrine falcon. <br />(Falco oereorinus). Therefore, the focus of this biological opinion is on the <br />impacts of Reclamation's proposed Federal action (described in this document) <br />on the currently occupied habitat of Federally endangered Colorado River <br />fishes. <br />
