Efforts at Quantification of Indian Reserved Water Ri~hts in the Missouri River <br />Basin <br /> <br />Both adjudications and negotiations are underway in the Missouri River Basin in <br /> <br />. <br /> <br />attempts to quantify or settle Indian claims to reserved water rights. The following <br /> <br />subsections list these efforts by state, omitting those states with no Indian lands in <br />the basin. <br /> <br />1. Iowa <br /> <br />The only Indian lands in the Missouri River Basin in the State of Iowa are <br /> <br />listed as tribal lands of the Winnebago Tribe now lying on the east bank of the <br /> <br />Missouri River, about 629 acres. The ownership of these lands was contested <br /> <br />for many years and awarded to the tribe in U.S. v. Flower (108 F. 2d 298). <br /> <br />The ownership of an additional 11,000 acres of land along the Missouri River in <br /> <br />Iowa is currently being contested by the Winnebago and Omaha Tribes. No <br /> <br />known litigation or negotiation is underway or contemplated regarding Indian <br /> <br />reserved water rights in the Missouri River Basin in Iowa. <br /> <br />2. Kansas <br /> <br />Indian lands in the Kansas portion of the Missouri River Basin total <br /> <br />approximately 26,000 acres on four Indian reservations (Iowa, Kickapoo, <br /> <br /> <br />Potawatomie, and Sac and Fox) and one small "reserve." No known litigation or <br /> <br />negotiation is underway or contemplated concerning Indian reserved water rights <br />in the Missouri River Basin in Kansas, although the state has held preliminary <br /> <br />discussions with the Kickapoo Tribe concerning water development on the <br /> <br />reservation. <br /> <br />-27- <br />
