The Indians c:I.aim a prior right to the use of water. Do I <br />understand that the'resolution woUld mean for the Indians to relinquish their <br />claim to prior right if they desir~ to participate in the project? <br /> <br />JUDGE STONE: No, what is meant by the resolution is that under the project <br />plan the whites wouJ.d have to pay all their operation and maintenance charges, <br />plus somethin~ towards. construction oosts. The Indians might ask that their <br />p,~ojects be entirelY subsidized from the pool even including their operation and <br />maintenance costs. <br /> <br />MR, WIlSON: IJbelieve that if the Indians participate it should be en the same <br />basis as the white tirojects. I believe that the first part of the resolution goes <br />too far. Congress;!has the right to build the Shiprook Project as guardians of the <br />Indians if they want to. <br /> <br />MR. BREITENSTELN: That is not the point. What we are trying to get at is <br />that if the Indian projects are to be repaid from the pool they should lOOet the <br />same criteria as wh~te projeots. <br /> <br />MR. WILSON; t assume that all participating projects, including the <br />Indians, would have llome ability to repay, <br /> <br />MR. lARSON: There is one point which you a.re overlooking. Congress; might <br />put up enough money to put the Indians on the same basis as the other projects and <br />the Indian Projects aould then participate on the same basis as the white projects. <br /> <br />MR.. EMIGH: How ,would you apply the formula to the Indian Projeots? It seems; <br />to me this is going to be very difficult as the amount to be repaid by white <br />projects varies greatly. <br /> <br />MR, lARSON: Th~ amount to JJe repaid is not a fixed amount for all projects. <br />It varies from area ~o area and depends on the ability of the water users to <br />repay. It is based c:Jn the value of crops grown, farm expenses and other economic <br />faotors, Detailed e&onomic studies are made for each project to determine what <br />this repayment ability is. <br /> <br />JUDGE STONE; Th~ formula would provide that water users should pay up to <br />their ability to pay !and meet all their operation and maintenanoe charges. The <br />percentage charge would vary in different localities. <br /> <br />MR. BLISS: There is merit in the resolution that the Indians determine economic <br />feasibility whether they pay it or not. <br /> <br />MR. MCDANIEL: I'move that the resolution be adopted, <br /> <br />MR. D. L. WILLIAiv1S: I second the motion. <br /> <br />MR. HUNTER I Que~tion.
