MR. BREITENSTEIN: The resol]lttion states only that the Indians and whites be
treated alike and does not ask fot ;~ite preference,
, I

MR. McDANIEL: ,. The Indians c:I.aim a prior right to the use of water. Do I
understand that the'resolution woUld mean for the Indians to relinquish their
claim to prior right if they desir~ to participate in the project?

JUDGE STONE: No, what is meant by the resolution is that under the project
plan the whites wouJ.d have to pay all their operation and maintenance charges,
plus somethin~ towards. construction oosts. The Indians might ask that their
p,~ojects be entirelY subsidized from the pool even including their operation and
maintenance costs.

MR, WIlSON: IJbelieve that if the Indians participate it should be en the same
basis as the white tirojects. I believe that the first part of the resolution goes
too far. Congress;!has the right to build the Shiprook Project as guardians of the
Indians if they want to.

MR. BREITENSTELN: That is not the point. What we are trying to get at is
that if the Indian projects are to be repaid from the pool they should lOOet the
same criteria as wh~te projeots.

MR. WILSON; t assume that all participating projects, including the
Indians, would have llome ability to repay,

MR. lARSON: There is one point which you a.re overlooking. Congress; might
put up enough money to put the Indians on the same basis as the other projects and
the Indian Projects aould then participate on the same basis as the white projects.

MR.. EMIGH: How ,would you apply the formula to the Indian Projeots? It seems;
to me this is going to be very difficult as the amount to be repaid by white
projects varies greatly.

MR, lARSON: Th~ amount to JJe repaid is not a fixed amount for all projects.
It varies from area ~o area and depends on the ability of the water users to
repay. It is based c:Jn the value of crops grown, farm expenses and other economic
faotors, Detailed e&onomic studies are made for each project to determine what
this repayment ability is.

JUDGE STONE; Th~ formula would provide that water users should pay up to
their ability to pay !and meet all their operation and maintenanoe charges. The
percentage charge would vary in different localities.

MR. BLISS: There is merit in the resolution that the Indians determine economic
feasibility whether they pay it or not.

MR. MCDANIEL: I'move that the resolution be adopted,

MR. D. L. WILLIAiv1S: I second the motion.

MR. HUNTER I Que~tion. "All those in favor say aye, contrary nay".
(Motion passed unanimQusly)

JUDGE STONE: Welshould consider at this time a group of ~articipating projeots.
This group would obviqusly include the following; Pine Rj.ver roject Extension,
Florida, La Plata in Qolorado and Hammond and La Plata in New Mexico.
-lO-

,.,

~
