"ill be delivered in accordance with the "Tulare Formula" <br /> <br /> <br />which is based on Solicitor's opinion M-36011 dated September 23, 1949, <br /> <br />This concept, in general, provides that project water .lill not be considered <br /> <br /> <br />to have been delivered to ineligible excess lands (i.e. excess lands not <br /> <br /> <br />wlder recordable contract) if during each 24-110ur period the contract}ng <br /> <br /> <br />entity delivers to such ineligible excess lands a quantity of water that <br /> <br />does not exceed that quantity available to it, during that same 2/.-hour <br /> <br />period from sources other than the project supply. <br /> <br />With the application of the l60-acre limitation to the NarrOl's <br /> <br />project, there still remains ample irrigable lands available to which <br /> <br /> <br />the.project water supply would be delivered.
