<br />-\ <br /> <br />-e <br /> <br />,...... <br />..~ <br /> <br />N <br />~ <br />co <br />--.J <br /> <br />. <br /> <br />.. <br /> <br />Questionnaire on Intep.!eta'l:,ion andJpplication <br />of-provisions-of-Stlpulation (in Colo. v Kan.) <br />of December 7, 1955. <br /> <br />1. <br /> <br />How should the 40,COO acre feet of water temporarily stored in Caddoa reservoir <br />as of March 12, 1945 which, by agreement, 'fIas allowed to accul!lulate, be <br />treated? <br /> <br />(a) As natural =egule.ted river flow, a considerable part. of which <br />~ ~ ~ diverted by Colorado canals for direct irrigation <br />during the storage period between Dec. ll, 1942 and March 11, 19~5. <br />. - <br /> <br />(During the period October 1, 1942 to March 11, 1945) about 2-1/2 tines <br />the quantity of water was delivered across the State line, as is re- <br />quired to be delivered betlYeen October 1, 1942 and April 1, 1945) <br />If so, then the division would be in the ratio of 160,000 acre feet <br />to 52,000 acre feet. <br /> <br />Answer: <br /> <br />(b) As "Surplus Water" to be divided eam>llv between Colorado and Kansas, during <br />the "Irrigation season of 1945 (April 1st to October 1st). <br /> <br />Answer: <br /> <br />(c) Since the Army Engineers require t~at the water now in storage be discharged <br />out of the reservoir by !.lay 1st, uhich rill not permit ColoraaoreneJ.s to <br />make the most beneficial use of their share. under (a), it would appear th:2t <br />the division of the 40,000 acre feet might be made on the basis of 60% to <br />Colorado and 40% to Kansas, based upon the relative amounts of decreed <br />water in Coloredo and Kansas, with some possible adjustment du=ing the <br />period of release, based upon the relative needs for water in both states. <br /> <br />Answer: <br /> <br />2. The Stipulation does not speeDY any rate of monthly uses of water in either <br />State. In the interest of equitable uses in both States, and as an essential <br />to oroper administration, it would appear necessary that deliveries and uses <br />of r.ater be based upon schedules of monthly deliveries, predicated upon past <br />uses or upon an ideal use during each month. <br /> <br />/ Answer: <br /> <br />.-- <br />
